Terms of Service

Eligibility and authority

You must be at least 18 years old and have the legal authority to enter into these terms. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization.

Use of service

You must comply with our Acceptable Use Policy and applicable laws. You are responsible for activity under your account.

Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us promptly if you suspect unauthorized use.

Accounts and billing

You agree to provide accurate account and payment information and to pay all fees associated with your selected plan. Unless otherwise stated, subscriptions renew automatically at the end of each billing cycle.

Payment processing is provided by Stripe and your payment transactions may be subject to Stripe's terms and privacy policy.

You authorize us to charge your payment method for recurring fees, applicable taxes, and any overage or usage-based charges. Late or failed payments may result in suspension or termination of access.

Plan changes, trials, and refunds

We may offer free plans, trials, or promotional credits at our discretion and may modify or revoke them at any time. Unless required by law, fees are non-refundable, including partial billing periods and unused credits.

We may change pricing or plan features with reasonable notice. Continued use after the effective date means you accept the updated pricing or features.

Availability

We strive for high availability but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the service at any time.

Customer content and intellectual property

You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your content solely as needed to provide and secure the service.

You represent that you have all necessary rights and permissions to send content and contact recipients, and that your use complies with applicable law and our Acceptable Use Policy.

Sendwich, including all software, trademarks, and service content, is owned by us or our licensors and protected by applicable law.

Feedback

If you provide feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.

Termination

You may stop using the service at any time. We may suspend or terminate access immediately if we reasonably believe there is a violation of these terms, the Acceptable Use Policy, applicable law, or a risk to users, recipients, or the platform.

Indemnification

You will defend, indemnify, and hold harmless Sendwich and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the service, or your violation of these terms or applicable law.

Warranty disclaimer

The service is provided "as is" without warranties of any kind to the fullest extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Sendwich is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill.

To the maximum extent permitted by law, Sendwich's aggregate liability for all claims related to the service will not exceed the total amount paid by you to Sendwich for the service during the 12 months before the event giving rise to the claim.

Governing law and disputes

These terms are governed by the laws of the jurisdiction where Sendwich is organized, excluding conflict-of-law rules. You and Sendwich agree to the exclusive jurisdiction and venue of courts in that jurisdiction, unless applicable law requires otherwise.

Changes to these terms

We may update these terms from time to time. If we make material changes, we will provide notice by updating this page and revising the "Last updated" date above. Continued use after the effective date constitutes acceptance of the updated terms.

General terms

If any provision of these terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these terms without our prior written consent.
